Service of Subpoena

Civista Bank honors lawfully issued subpoenas. Civista Bank will accept service of subpoenas at any Civista Bank branch or loan production office. Please note that Civista Bank has numerous locations in different states, so mailing or hand delivery of subpoenas to these locations may risk delay and/or rejection. Service as described above is likely to be the most efficient.

Subpoena Requirements

In order to be valid, subpoenas must:

• State the name of the court from which it is issued, the title of the action and the case number;

• Be issued to the correct entity;

• Be signed and dated;

• Provide either a customer’s full SSN/EIN, customer’s account number, customer’s full name and last four digits of SSN/EIN, or customer’s full name and last five digits of account number;

• Identify documents/records being requested with a specific time period;

• Served according to Section (B) of Ohio Civ.R. 45; and

• Set forth the text of Sections (C) and (D) of Ohio Civ.R. 45.

Payment for Records

Ohio law (R.C. 9.02(B)) requires that Civista Bank be reimbursed for its costs in searching for, reproducing and transporting records. Civista Bank will include an invoice with the records being sent to you and reserves the right to charge reasonable costs and/or administrative fees. Civista Bank may request partial payment prior to the production of documents in response to any subpoena. Civista Bank's subpoena compliance fees incorporate time spent performing research and fulfillment.
